Consumer Protection

The law of Consumer Protection and consumer rights in Tennessee addresses several statutory provisions, such as the Tennessee Consumer Protection Act, as well as common law doctrines such as fraud, misrepresentation and breach of contract.

Our services to individuals in the area of consumer protection include representation in disputes with merchants and vendors who have violated the rights of the consumer.  For example, you may have purchased a "performance service plan" or "extended warranty" from one of the "big box" retailers (e.g., Best Buy) only to later find out that what they told you concerning your rights as a consumer should something go wrong with your new cell phone, television, computer or even car stereo is not entirely or even colorable true.  Typically, these big box retailers tell you the performance service plan or extended warranty protects against substantially all performance problems - like a factory warranty - and then they quote you a price.  They generally do not hand you the performance service plan before selling you the plan nor do they show you or even suggest at all of the exceptions, qualifications, and exclusions in the plan.  An internet search on several of these "big box" retailers will demonstrate that there are claims of fraud, consumer abuse and rip-offs throughout the country.  You will also learn that for some of them these extended warranties and performance service plans are a key part of their profit strategy.  We can help you if you find yourself in this situation.  These big box retailers are betting however that you will not take them to court over their denial of service and consequently, they profit.  What they hope you do not know is that Tennessee statutory law under the Consumer Protection Act can award you not only your damages, but also as much as three times your damages plus attorney's fees against these unfair and deceptive trade practices.
